These Terms and Conditions ("Terms") govern your use of the Livetea.ch platform ("Service"). The Service is provided by Lingua House sp. z o.o., registered at ul. Lea 114, 30-133 Krakow, Poland.

By accessing or using the Service, you agree to abide by these Terms. If you do not agree, you should not use the Service.

1. DEFINITIONS

In this agreement, the following definitions and rules of interpretation apply:

• Agreement: This agreement between us and you, incorporating these Terms.
• Intellectual Property Rights: All intellectual property rights, including but not limited to copyrights, trademarks, database rights, or similar rights recognized worldwide.
• Service: The livetea.ch platform, including all associated tools, features, and services.
• Website: The site accessible at https://livetea.ch.
• You or Your: The person or entity using the Service.
• User Roles: Manager, Teacher, Student, and Parent.
• Subscription Plan: A paid subscription granting access to additional features.
• Free Trial: A 14-day free trial offered without requiring a credit card.

2. GENERAL TERMS

2.1 Access and Registration

• You must register with a valid email address or an approved login method, e.g. Google or Facebook.
• You are responsible for protecting your login credentials. You may not impersonate anyone, share login details, or access another user's account.
• You are accountable for all activities under your account, even if they occur without your knowledge. If you suspect unauthorized use of your account or password, please notify us immediately at support@livetea.ch.

2.2 Service Use

• Certain content is available only through a paid subscription. You may not attempt to access paid content without paying the subscription fee.
• Livetea.ch provides an online environment for remote teaching, including video conferencing, interactive exercises, private study spaces, and a classroom management dashboard. These Terms may be updated when new features are introduced.
• You may not resell or redistribute access to the Service or any of its features without our written permission.

3. SUBSCRIPTIONS

3.1 Subscription Tiers

Livetea.ch offers the following tiers:

All tiers include interactive exercises, private study spaces, guest user access, automatic validation, a whiteboard, and an embedded multimedia player. Some tiers also offer additional capabilities such as lesson history, flexible breakout rooms, multiple teachers per session, an API, user management, course/lesson scheduling, attendance reports, and enterprise features like SSO, custom domains, or local deployments.

3.2 Free Trial

New users are entitled to a 14-day free trial without providing a payment method. After the trial period, an active Subscription Plan is required for continued use.

3.3 Payments and Renewals

Subscription Plans renew automatically unless canceled at least seven working days before the renewal date. You can cancel via email or, where applicable, through PayPal. Prices are listed in PLN, EUR, GBP, or USD and include VAT if required.

Additional seats can be purchased at the following monthly or yearly rates:

• Extra Student (Monthly): 2 USD / 3 EUR / 2 GBP / 9 PLN
• Extra Student (Yearly): 15 USD / 19 EUR / 12 GBP / 69 PLN
• Extra Teacher (Monthly, where applicable): 10 USD / 10 EUR / 7 GBP / 49 PLN
• Extra Teacher (Yearly, where applicable): 99 USD / 99 EUR / 69 GBP / 399 PLN

4. PRIVACY AND DATA

4.1 Personal Data

We collect and process personal data, including login details, attendance records, and usage patterns, in accordance with our Privacy Policy.

4.2 Minors

Minors may use the Service with parental or institutional supervision. Parents, guardians, or schools are responsible for monitoring minors' activities.

5. PLATFORM AVAILABILITY

5.1 Maintenance and Updates

We may temporarily suspend or limit access for maintenance, upgrades, or security reasons. We will make reasonable efforts to minimize any disruptions.

5.2 No Guarantees

We do not guarantee uninterrupted or error-free audio and video conferencing. These features depend heavily on your Internet Service Provider's (ISP) network infrastructure, which is outside our control. As a result, connection issues or poor call quality alone do not constitute grounds for a complaint or any claim against us.

6. INTELLECTUAL PROPERTY

All content and branding on the Livetea.ch platform are owned by Lingua House sp. z o.o. No rights to this intellectual property are granted to you other than those explicitly stated in these Terms.

7. LIABILITY

Except in cases of deliberate misconduct or fraud, we are not liable for:

1. Actions taken based on platform content.
2. Technical issues beyond our control.
3. Indirect or unforeseeable losses.
4. Business losses or interruptions.

8. TERMINATION

We may suspend or terminate your access to the Service if you breach these Terms. Upon termination:

1. Your license to use the Service ends.
2. You must cease using any proprietary content.
3. We may remove or delete your data from our systems.

9. GOVERNING LAW

These Terms are governed by Polish law, and any disputes shall be resolved by the courts of Poland.
